Terms and Conditions
1 DEFINITIONS
1.1 "Buyer" means the individual or organisation who buys or agrees to buy the Goods from the Seller
1.2 "Contract" means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions;
1.3 "Goods" means the articles that the Buyer agrees to buy from the Seller
1.4 “Seller" means the Proprietor Lauren Booth trading as Aspire Beauty 72 Reading Road Yateley Hants GU46 7UH.
1.5 "Terms and Conditions" means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller
2 CONDITIONS
2.1 These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer
2.2 Any variation to these terms and conditions shall only apply if made in writing by the Seller
2.3 Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer's acceptance of these Terms and Conditions.
2.4 Contracts are subject to the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
3 ORDERING and CANCELLATION
3.1 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.
3.2 Where the Goods ordered by the Buyer are not available from stock the Buyer shall be notified and given the option to either wait until the Goods are available from stock or cancel the order and receive a full refund. In the case of specially ordered products such as furniture delivery times may go beyond 30 days and Buyers will be notified of the anticipated delivery date
3.3 Items not in stock that are ordered specifically to fulfill an order cannot be cancelled.
4 DELIVERY
4.1 The sellers aim is to despatch goods within 24 hours of receiving an order but this may vary subject to availability. Delivery times will be estimated at the time of order but times quoted are not binding on the Seller.
5 PRICE AND PAYMENT
5.1 The Price of the Goods shall be that stipulated in the catalogue and the Seller's Website but are subject to change without notice. The Price is exclusive of VAT and delivery charges.
5.2 In the case of web site orders once the order is received the Seller shall confirm by email the details, description and price for the Goods.
5.4 Payment of the Price plus VAT and delivery charges must be made in full before despatch of the Goods.
5.5 Title to goods does not pass from the Seller to the Buyer until payment is received in full.
6 SHORTAGES, DAMAGES and RETURNS
6.1 Any damaged goods must be reported within 24 hours of receipt.
6.2 Any incorrectly fulfilled items must be returned in the original packaging and condition to: Returns Department, Aspire Beauty 72 Reading Road Yateley Hants GU46 7UH.
6.3 Any shortages/non deliveries must be reported within 10 working days of receipt of invoice.
6.4 Postage costs will be refunded only if the return is necessitated by an error on the part of the Seller
6.5 If the Buyer requests a refund, payment for the item will be refunded within 30 days. If the Buyer paid by credit card the refund will be made to the card. Otherwise a cheque will be sent to the Buyer within this period.
6.6 Refunds for any returned goods lost in transit will only be made on receipt of proof of postage.
7 RIGHTS OF SELLER
7.1 The Seller reserves the right to adjust the price and specification of any item at its discretion.
7.2 The Seller reserves the right to withdraw any goods at any time.
7.3 The Seller shall not be liable to anyone for withdrawing any Goods or for refusing to process an order.
8 FORCE MAJEUR
8.1 The Seller shall not be liable for non delivery or delay if the Seller is prevented from fulfilling an order due to circumstances beyond its control such as but not limited to industrial action, fire, Act of God or failure to deliver by carriers or suppliers.
